Terms and Conditions of the “Beauty Expert Online” Website

These Terms and Conditions define the rules for using the “Online Beauty Academy” website available at www.beautyexpert.io. By using this website, you agree to comply with these Terms and Conditions. If you do not accept them, please exit www.beautyexpert.io.

§1. DEFINITIONS

For the purpose of these Terms and Conditions, the following terms shall have the meanings assigned below:

Administrator / Seller – the company KYNES Sp. z o.o. with its registered office at ul. Mieczykowa 18A, 65-012 Zielona Góra, Poland, registered in the National Court Register (KRS) under number 0001124595, NIP: 9292085432, REGON: 529564606. Contact email: online@beautyexpert.io.

Terms and Conditions – this document, available at https://www.beautyexpert.io/regulamin-uslug.

Platform / Service – the website "Beauty Expert Online" available at www.beautyexpert.io, through which the Seller provides Clients with access to educational content in cosmetology, including graphic, text, audio, and video materials.

Visitor – any natural person, legal person, or organizational entity with legal capacity who uses the Platform without being logged in or having a registered account. The Visitor may access only the publicly available content, such as:

  • the “Home” page – with general information about the service,
  • the “FAQ” section – with frequently asked questions and answers,
  • the “Contact” page – including contact details and a contact form,
  • the “About Us” section – with information about the Seller and the training programs,
  • the “Program” section – with a list and descriptions of online lessons,
  • the “Pricing” section – with current pricing for the services.

Client / Participant – a person who has successfully completed the registration form and purchased access to a selected payment plan, thereby receiving login credentials and access to the Platform. Clients may be individuals, legal entities, or organizational units with legal capacity.

Consumer – an individual using the Service for purposes not directly related to their business or professional activity, or an individual entering into a contract related to their business, provided the nature of the contract does not relate to their professional qualifications as defined by business registration records.

Service / Access / Course – the electronic service provided by the Seller via the Platform, which includes access to educational training materials in cosmetology (text, graphics, video, and audio) under the terms defined in these Terms and Conditions.

Account / Platform Access – the user account system that provides:

  • in the “ONLINE LESSONS” panel – information about the training materials already purchased and available to the Client, or those the Client can still purchase access to, as well as Certificates and Exams available to the Client if they meet the conditions specified in the Terms and Conditions.
  • in the “TRANSACTION HISTORY” panel – information regarding all past payments made by the Client to the Seller.
  • in the “PAYMENT PLAN” panel – information about available Payment Plans that the Client can choose from, or the currently selected plan, including the amount due for access to the Service provided by the Seller. In this panel, the Client can activate a specific Payment Plan by clicking the “ACTIVATE PLAN” button after marking the legally required consents, including confirmation of having read the Terms and Conditions.
  • in the “ACCOUNT DETAILS” panel – information about the personal data provided by the Client in the Registration Form and additional data provided or available for completion, such as invoicing details for issuing a VAT invoice for the Service. The Client may select whether the data applies to an individual or a business. This panel allows partial changes to Login Details, personal information, and invoicing data, except for the first and last name entered in the Registration Form, which can only be changed after contacting the Seller. Clicking the active link titled “contact the administrator” in the panel redirects the Client to the “CONTACT” panel.
  • in the “CHANGE PASSWORD” panel – includes input fields which, after being filled out and confirmed by clicking the “CHANGE PASSWORD” button, allow the Client to set a new password for their Account, thus updating the Login Details.

Login Details – the Client’s email address (Login) and password set during the Registration Form process, which allow access to the Platform once the payment for Platform Access has been successfully completed. Login Details can be changed by the Client within the Platform.

Payment Plan – divided into Recurring Payment and One-Time Payment. Recurring Payment means the Client agrees to pay $169 per month for access to the Service – this amount provides access to 4 Online Lessons. One-Time Payment requires the Client to pay upfront for access to all Lessons available on the Platform – the total fee is $1299, which includes a discount compared to the Recurring Payment total. Choosing a specific Payment Plan and completing the payment is required to access the Service.

Minimum Fee – the amount of $169 from the Recurring Payment Plan, granting access to 4 Online Lessons. This fee is non-refundable if the Client withdraws from the agreement as described in §9 of the Terms. It represents the Seller’s compensation for the first Billing Period.

Billing Period – a 30-day period during which the Client receives access to Online Lessons under the Recurring Payment Plan. It begins on the day of the monthly payment and ends the day before the next monthly payment is due.

Online Lesson – a unit into which the Training is divided on the Platform. The Service consists of 48 Lessons, each covering a specific area of cosmetology in both theory and practice. Lessons are released every 7 days. A new Lesson is unlocked weekly as part of the selected plan. Under the Recurring Payment Plan, the Client receives 4 Lessons for a 30-day period. Continued access to additional Lessons requires further monthly payments. Under the One-Time Payment Plan, the Client gains full access to all Lessons for the entire Training Period.

Training Period – a 12-month duration starting from the first payment and release of the first Online Lesson.

Account Subscription – a feature available for Clients who completed the Training and wish to retain access to the materials after the Training Period ends. Accessible via the “Payment Plan” panel, it offers two options: monthly payment of $15 or annual payment of $99. During an active Subscription, the Client has unlimited access to previously purchased training materials.

Certificate – a downloadable PDF document issued by the Seller to confirm that the Client completed a specific Lesson. To download a Certificate, the Client must score 100% on the corresponding Quiz and pay the required fee.

Diploma – a downloadable PDF document issued by the Seller to confirm that the Client passed the Final Exam and successfully completed the entire Training.

Quiz – a test of 5 questions assessing the Client’s knowledge of a particular Lesson. Only a perfect score (100%) allows the Client to purchase a Certificate for that Lesson. Each Online Lesson contains a Quiz.

Practice Exam – a mock test available at any time during the Service to help the Client prepare for the Final Exam. It can be accessed until the Subscription is canceled, Recurring Payments stop, or the contract ends. Taking the Practice Exam is not required to proceed to the Final Exam.

Final Exam – the final Quiz that a Client can take after completing all 48 Online Lessons and earning a perfect score on each regular Quiz (excluding the optional Practice Exam).

Registration Form – the form filled out by the Client during account registration to access the Service. It is available at: https://www.beautyexpert.io/en/registration

Password – a string of characters defined by the Client during account registration.

Username (Login) – the Client’s email address used during account registration.

Login – identity confirmation by entering the Username and Password.

Payment Operator – PayPal (international use only).

Contact Form – the form available at https://www.beautyexpert.io/en/contact allowing the Client to send a message to the Seller's support email.

§2. GENERAL PROVISIONS

1. The service of access to paid content (including graphic, text, audio, and video materials available on the Platform) is provided by the Seller. Paid services offered by the Seller include access to the Platform and access to educational content in the form of Online Lessons, granted upon prior payment by the Client (Service Access).

2. The provision of services on the Platform is governed by these Terms and Conditions.

3. These Terms and Conditions define the general rules forming the legal basis for the use of services available on the Platform. Each Client is obliged to comply with the provisions of these Terms and Conditions from the moment they initiate any activity aimed at using the services.

4. Before using the services, the Client should carefully read these Terms and Conditions. By starting to use the services, the Client confirms they have read, accepted, and agreed to comply with all the provisions herein.

5. Using the Platform does not require any specialized equipment or software. However, the Client acknowledges that purchasing and using services through the Platform requires the following technical requirements to be met by the device they use:

  • a web browser that supports HTML, CSS, and JavaScript,
  • JavaScript enabled,
  • Cookies enabled,
  • internet access,
  • a commonly used operating system,
  • the ability to play video files,
  • an active email address.

6. Due to the nature of the internet and third-party hardware, the Seller does not guarantee uninterrupted or error-free access to the Platform. The Seller is not liable for any interruptions or disruptions in service resulting from internet connectivity or technical issues related to the Client’s device.

7. The video materials available as part of the Service are provided in Polish. The quality of video playback may vary depending on the Client’s internet connection and device specifications.

8. Clients may not make purchases anonymously or under an alias. Clients are strictly prohibited from engaging in any activities that violate applicable laws, especially actions that infringe on third-party rights, such as accessing other Clients’ accounts without authorization or attempting to acquire other users’ Login or Password details.

9. Clients are prohibited from submitting illegal content, especially via the Registration Form or the Contact Form available on the Platform. Clients are also prohibited from sharing Platform content or Login Details with third parties under penalty of losing access to the Platform.

10. Whenever the purchase of a specific service requires the Client to confirm the waiver of their right to withdraw from the agreement, and the Client selects this option and completes the purchase, a confirmation of that declaration will be sent to the Client’s email address provided in the Registration Form.

§3. COPYRIGHTS

1. The Seller declares that all training materials published on the Platform are original works within the meaning of the Polish Copyright and Related Rights Act of February 4, 1994 (Journal of Laws of 2022, item 2509), and that the copyright to these works belongs exclusively to the Seller.

2. By purchasing access to these works, which are not distributed as physical copies but made available digitally through the Platform, the Client acquires the right to view or play the content solely for personal, non-commercial use. In particular, the Client is not allowed to publicly display the works, copy them in whole or in part, reproduce, redistribute, modify, incorporate into other works, or share them with third parties.

3. The Seller reserves the right to use publicly available works for educational and academic purposes in the process of creating materials for the Platform.

4. Any violation of the provisions in this section may result in civil and criminal liability as defined by the Polish Copyright and Related Rights Act of February 4, 1994 (Journal of Laws of 2022, item 2509).

§4. ACCESSING THE PLATFORM

1. Access to the Platform is granted to the Client in the following way: the Client follows the instructions provided on the website https://www.beautyexpert.io/en by clicking the "CREATE ACCOUNT" banner located in the "MY ACCOUNT" panel in the top right corner of the site. The Client is then redirected to https://www.beautyexpert.io/en/registration where they fill out the registration form, providing their personal information, email address (Login), and creating their own Password, as well as selecting the preferred Payment Plan. After clicking the "CREATE ACCOUNT" button, the Client is redirected to the Payment Operator's website to complete the payment for the Service using the available methods, in the amount corresponding to the selected Payment Plan.

2. Completing the Minimum Payment is required to register the Account and gain access to the Platform. Upon successful payment, the Client is granted access to the Service in accordance with the selected Payment Plan. Registration as described in this section requires acceptance of the statements regarding the processing of personal data and consent to the immediate commencement of the Service, which results in the loss of the right to withdraw from the agreement with the Seller. This is necessary to complete the purchase and gain access to the Platform.

3. Access to the Platform is granted for an indefinite period once the first payment is confirmed. Therefore, access is subject to the Client completing the Registration Form and making at least the Minimum Payment equivalent to one monthly installment under the Recurring Payment plan. At that moment, the contract for the provision of digital content is deemed concluded between the Client and the Seller for an indefinite period. The Client may terminate the agreement for Platform access at any time by sending an email to: online@beautyexpert.io or by mailing a written notice to the Seller’s registered office address.

§5. ACCESS TO THE SERVICE

1. Once the Client makes the payment according to the selected Payment Plan, they gain access to the Service by receiving access to the first part of the training material prepared by the Seller. This first part consists of Online Lessons, which are made available to the Client during the Billing Period, in numerical order, week by week. Each Online Lesson is therefore released to the Client every 1 (one) week throughout the Training Period, starting with the first Online Lesson, which is made available on the day the first payment is made. The Minimum Payment is required to gain access to both the Platform and the Service. Failure to select a Payment Plan and make the payment prevents registration of the Account and, consequently, access to the Platform and the Service.

2. By selecting the Recurring Payment option, the Client agrees to pay the Seller a monthly training fee of $169, which covers account registration (for the first payment) and access to Online Lessons released weekly during each Billing Period. To gain access to further Online Lessons and continue the Training after the initial Billing Period, the Client must make the next monthly payment as per the selected Recurring Payment plan. The Seller will notify the Client 5 days before the due date of the next Recurring Payment (30 days from the previous payment). The email will include a link redirecting the Client to the Payment Operator’s site to make the payment. Additionally, information about the next payment date will be visible in the Client’s Account.

3. By selecting the One-Time Payment option, the Client agrees to pay the Seller a one-time training fee of $1299, which covers account registration (for the first payment) and access to all 48 Online Lessons, made available sequentially each week throughout the entire Training Period, starting from the date of the One-Time Payment. This plan includes a 35% discount compared to the total cost under the Recurring Payment option.

4. For the second and any subsequent payments, the Client may purchase the Service directly from their Account. In the "PAYMENT PLAN" panel, after accepting all legally required consents—such as agreement with the Terms and Conditions, consent to data processing, and consent to immediate provision of the Service resulting in loss of the right to withdraw from the contract—the Client clicks the "ACTIVATE PLAN" button and is redirected to the Payment Operator’s website to make the payment according to the selected Payment Plan.

5. The Seller may refuse to register an Account or provide the Service, or may block access to the Platform, in the following cases:

  • if the Client incorrectly fills out the registration form,
  • if the Client provides false information,
  • if the Client violates the rights of the Seller or third parties,
  • if the Client violates any provision of these Terms and Conditions,
  • if the Client owes any due and unpaid amounts to the Seller for any reason,
  • if the Client uses the Platform to commit an offense or crime, or acts in a way contrary to social norms or constitutes an abuse of
  • rights inconsistent with their socio-economic purpose,
  • if the Client interferes with the functioning of the Platform without the Seller’s prior written consent,
  • if the Client shares their Login and Password with third parties.

§6. PAYMENTS

1. When purchasing access to the Platform and the Service, the Client can make the payment using PayPal. The Seller is not responsible for the proper execution of the payment process on the Payment Operator’s platform and has no influence over the actions taken by the Payment Operator or its partners. By making a payment through the Platform, the Client agrees to the terms and conditions of the websites operated by the Payment Operator and the institutions cooperating with it, as well as any requirements imposed by them.

2. Once the payment has been successfully completed, the Client will be redirected to a confirmation page on the Platform. At this point, the contract for the provision of digital content in the form of the Service is considered concluded between the Client and the Seller, according to the selected Payment Plan and the corresponding scope of training materials provided by the Seller. Confirmation of the concluded agreement is the purchase confirmation, which will also be sent to the Client’s email address (used as their Login) provided in the Registration Form. Along with the confirmation, the Seller will send the Client a PDF invoice confirming the payment.

3. If, for any reason—including technical issues—the payment could not be completed, the Seller will notify the Client about the temporary inability to activate access to the Platform or the Service and provide an estimated resolution time. The Client is not entitled to claim compensation or any other form of redress due to this temporary lack of access to the services provided by the Seller.

4. All prices for services provided by the Seller through the Platform are gross prices, including VAT applicable at the time these Terms and Conditions are in force.

§7. ACCESS TO ACCOUNT AND SERVICE

1. Access to the Platform is granted to the Client through the registration of an Account, which can be accessed using the Client’s login credentials. Registering the Account and logging in for the first time constitutes confirmation of the beginning of the agreement between the Client and the Seller, in accordance with the Act on Providing Electronic Services of July 18, 2002, for an indefinite period.

2. Access to the Service is granted to the Client via the Platform for a limited time — 30 days in the case of a monthly payment under the Recurring Payment Plan, or 12 months under the One-Time Payment Plan — starting from the date of payment. During this time, the Client may access the training materials made available in their Account. In the case of the Recurring Payment Plan, the Client agrees to make successive monthly payments for each part of the Course during the Course Duration, provided that payments are made regularly in accordance with §5(2) of the Terms. Each Online Lesson remains available until the end of the Course Duration, as long as the Client continues or has completed the payment obligations. After the Course Duration ends, access to the content is removed unless the Client purchases an active Account Subscription as described in §7(6).

3. If the Client chooses to cancel further monthly payments under the Recurring Payment Plan, they agree to lose access to the training materials and all progress made in the Course. Cancellation is available directly from the Client’s Account panel under "Payment Plan" by clicking the green button labeled “Cancel future payments.” This action results in:

  • loss of access to previously unlocked Online Lessons (a message encouraging the Client to reactivate their training plan will be displayed in the "Online Lessons" panel),
  • deletion of previous quiz scores (quizzes must be retaken after reactivating the Course),
  • loss of access to purchase additional Certificates (only those previously purchased will remain available),
  • the need to restart the Course from the first Online Lesson if they choose to return later.

4. After the Course Duration ends, or after canceling future payments under the Recurring Payment Plan, the Client loses access to all previously purchased training content. They will still be able to:

  • download a Diploma (if they passed the Final Exam),
  • download previously purchased Certificates (if they passed the Quiz with 100% accuracy),
  • view the transaction history in the "Transaction History" panel. Continued access to training materials is only available to Clients who passed the Final Exam and activated the Account Subscription described in §7(6).

5. If the Client does not cancel future payments but fails to make the required monthly payments, access to new Online Lessons will be paused. To regain access and resume progress, the Client must pay for the missed Lessons. However, the Course Duration still ends 12 months after the initial payment and is not extended due to missed payments.

6. The Account Subscription allows the Client to review previously purchased training materials after the Course Duration. The subscription lasts for up to 12 months from activation and is available only to Clients who completed the Course and passed the Final Exam. After the subscription expires, it can be renewed. By selecting a Subscription Plan and completing the payment, the Client enters into a new digital service agreement with the Seller. The Client must also consent to data processing and immediate delivery of services, waiving the right to withdrawal.

7. The Client is responsible for keeping their login credentials confidential and for preventing unauthorized access. The Seller is not liable for any unauthorized use due to inadequate security of login credentials.

8. An active internet connection is required to use the Service. Internet usage costs are determined by the Client’s service provider. The Seller does not charge any additional fees for internet access.

9. The current pricing for Platform and Service access is listed on the Website. The Seller reserves the right to modify prices, conduct promotions, and change offers. Changes do not apply retroactively and do not entitle the Client to a refund for previously paid Services.

10. The Client may use the training materials on multiple devices simultaneously, strictly for personal use only.

11. The Client may reset their password by clicking “Forgot password” on the login page at https://www.beautyexpert.io/login. A new password will be generated and sent to the email address used during purchase. Alternatively, the Client may contact the Seller by email to request a manual password reset.

12. The Seller reserves the right to permanently block the Client’s access to the Platform and all Services in the following cases:

  • violation of any provision of these Terms,
  • termination of the Platform or business operations (with prior notice to the Client).

13. The Seller reserves the right to update the training materials and Terms of Use. Any content purchased by the Client will remain available under the conditions described in these Terms and at the time of purchase.

§8. QUIZ AND CERTIFICATES

1. After reviewing the training materials included in each unlocked Online Lesson, the Client may assess their knowledge by completing a Quiz. Once the "Check Answers" button is clicked, the system will display which answers were correct. The Quiz can be attempted an unlimited number of times during the active access period within the Course Duration. The highest score achieved is displayed in the "Online Lessons" panel, at the top of the lesson tile in which the Quiz was taken.

2. Achieving a score of 100% on a Quiz grants the Client the option to purchase a Certificate confirming completion of the training in that specific subject. The fee for generating a Certificate is $15. Certificates can be purchased at https://www.beautyexpert.io/online-lessons/certificates, or directly from the left-hand menu of each Online Lesson by clicking “Buy Certificate” or “Download Certificate” under the respective Online Lesson. Once payment is confirmed, the Certificate can be downloaded at any time from the Client’s Account in PDF format.

3. Canceling recurring payments during the Recurring Payment Plan or reaching the end of the Course Duration does not revoke access to Certificates previously purchased. However, the Client will not be able to buy new Certificates for other Online Lessons unless access to those lessons is reactivated through a valid payment plan.

4. Certificates are issued with the Client’s full name and are valid for one individual per Account. Any request to change the name associated with an Account must be submitted to the Seller and approved at their discretion.

§9. EXAM AND DIPLOMA

1. Throughout the active access period to the Service, the Client may assess their knowledge by completing a Practice Exam, which simulates the structure and format of the Final Exam. The only requirement is that the Client has paid for access according to the chosen Payment Plan. Completing the Practice Exam is optional and does not require achieving 100% on the individual Quizzes from the Online Lessons.

2. After completing the Course Duration and accessing all 48 Online Lessons, the Client is eligible to take the Final Exam.

3. The Final Exam consists of 20 single-choice questions and serves as an advanced version of the Lesson Quizzes. A minimum score of 80% correct answers is required to earn the Diploma, confirming full completion of the Online Academy.

4. Canceling recurring payments or reaching the end of the Course Duration does not revoke access to the previously generated Diploma.

5. The Final Exam may also be taken after the Course Duration ends, without the need to activate a Subscription. The first two attempts are free of charge. To access them, the Client must have completed the full course (all 48 Online Lessons) and reached the end of the Course Duration.

6.The third and each subsequent attempt at the Final Exam requires an additional payment of $59. This payment can be made directly from the Client’s Account. The “Take Exam” button in the “Online Lessons” section will prompt the payment before allowing the attempt. After the payment is received, the Client may immediately retake the exam. As with all digital services, the Client must accept the data processing terms and waive the right to withdraw from the contract once the service is provided.

7. After passing the Final Exam, the Client will receive a personalized Diploma in PDF format at no additional cost, confirming the successful completion of the entire program.

§10. WITHDRAWAL FROM THE CONTRACT

1. This section applies exclusively to Consumers. It also applies to individuals who enter into a contract directly related to their business activity, provided that the contract does not have a professional character for them, as determined by their registered business profile.

2. A Client who enters into a contract with the Seller for access to the Platform has the right to withdraw from the contract without giving any reason within 14 days from the date of the agreement. Withdrawal will result in termination of the Account access after the first Billing Period.

3. Withdrawal from the contract does not entitle the Client to a refund of the Minimum Fee. The Client loses this right due to having agreed to immediate access to the Service during registration, which was confirmed via an email sent to the Client. Even after withdrawal, the Client retains access to the course materials until the end of the first Billing Period, after which access is disabled.

4. Clients who chose the One-Time Payment option and lawfully withdraw from the contract are entitled to a partial refund—the total amount paid minus the Minimum Fee. The Minimum Fee of $169 is non-refundable, as it covers the first Billing Period. The Client is not entitled to a proportional refund of the discounted amount offered in the One-Time Payment Plan.

5. To withdraw from the contract, the Client must notify the Seller of their decision by sending a clear statement of withdrawal—either by traditional mail to the registered address of KYNES Sp. z o.o. or via email to online@beautyexpert.io, with the subject line: “WITHDRAWAL FROM CONTRACT”.

6. To meet the withdrawal deadline, it is sufficient to send the withdrawal request before the 14-day period expires, starting from the moment access credentials were issued.

7. In the event of withdrawal, the Seller will deactivate the Client’s Account after the first Billing Period. The Seller will also cease processing any personal data of the Client that was not required to deliver services before the deactivation.

§11. COMPLAINTS

1. The Client has the right to submit a complaint regarding the operation of the Website, as well as the processing of their personal data.

2. Complaints related to payment transactions handled by the Payment Operator must be submitted directly to the Payment Operator, in accordance with the terms of the transaction. The Seller does not process complaints regarding payment procedures within the Operator’s system.

3. Complaints concerning access to the Platform, access to the Service, operation of the Registration Form, or other Website functionalities should be submitted by email to: online@beautyexpert.io, with the subject line “COMPLAINT”.

4. Complaints will be reviewed by the Seller without undue delay, but no later than 14 days from the date of receiving the complaint. The Seller reserves the right to extend this deadline if the complaint lacks essential information or is unclear, making it impossible to process within the standard timeframe.

5. The response to the complaint will be sent to the Client by email to the address provided when submitting the complaint, unless the Client specifically requested a traditional written response by mail.

6. For Clients who are not Consumers, the statutory warranty is excluded. The Seller does not provide a guarantee for the Service and does not warrant that the training materials will always be up to date.

§12. FINAL PROVISIONS

1. The governing law for all legal relations arising from the Client's use of the Service is the law of Poland.

2. A dispute may be resolved by an arbitration court only after the complaint procedure has been completed and if both parties agree to arbitration. In all other cases, disputes will be submitted to the competent common courts in accordance with the provisions of the Code of Civil Procedure. The court competent to resolve disputes related to the provision of the Service shall be the court with jurisdiction over the Seller’s registered office. This provision does not apply to consumers.

3. If any part of these Terms and Conditions is or becomes invalid or unenforceable, this shall not affect the validity and enforceability of the remaining provisions. For matters not regulated herein, the relevant provisions of applicable law shall apply.

4. The Seller reserves the right, within the limits permitted by applicable law, to make changes or modifications to these Terms and Conditions for valid reasons related to technical or substantive aspects of the Website’s functioning, in particular due to changes in applicable legal regulations. Clients will be informed about changes via email no later than 7 days before the new version of the Terms and Conditions takes effect. Changes to the Terms and Conditions will not affect Services already provided to the Client.

5. The provisions of the Terms and Conditions in force at the time the Client places the order for access to the Platform and the Service shall apply, at least for the first Billing Period. Any changes to the Terms and Conditions will be communicated to the Client on the Website.
